testRigor knows that you care how information about you is used and shared, and we appreciate your trust that we will do so carefully and sensibly. This notice describes our privacy policy. By visiting testrigor.com, you are accepting the practices described in this Privacy Notice.

What personal information about customers does testrigor.com gather?

The information we learn from customers helps us personalize and continually improve your experience at testrigor.com. Here are the types of information we gather.

Information You Give Us: We receive and store any information you enter on our Web site or give us in any other way. You can choose not to provide certain information, but then you might not be able to take advantage of many of our features. We use the information that you provide for such purposes as responding to your requests, customizing future services for you, improving our service, and communicating with you.

Automatic Information: We receive and store certain types of information whenever you interact with us. For example, like many websites, we use ‘cookies,’ and we obtain certain types of information when your web browser accesses testrigor.com or advertisements and other content served by or on behalf of testrigor.com on other websites, including information from visitors of the website, for example, analytics and system information collected.

Cookies: We may log information using “cookies.” Cookies are small data files stored on your hard drive by a website. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our Site. Other similar tools we may use to collect information by automated means include web server logs, web beacons and pixel tags. This type of information is collected to make the Site and Services more useful to you and to tailor the experience with us to meet your interests and needs. More details in the next section.

Analytics: We may use analytics tools (such as those provided by Google Analytics) to help analyze how users use the Site. These providers use Cookies to collect information such as how often users visit the Site, what pages they visit, and what other sites they used prior to coming to the Site. We use the information we get from these analytics providers to improve our Site and the Services. Although they plant persistent Cookies on your web browser to identify you as a unique user the next time you visit the Site, the Cookie cannot be used by anyone but the analytics provider.

E-mail Communications: To help us make e-mails more useful and interesting, we often receive a confirmation when you open e-mail from testrigor.com if your computer supports such capabilities. We also compare our customer list to lists received from other companies, in an effort to avoid sending unnecessary messages to our customers.

What about cookies?

Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your Web browser to enable our systems to recognize your browser and to provide features based on who you are.

The Help portion of the toolbar on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Additionally, you can disable or delete similar data used by browser add-ons, such as Flash cookies, by changing the add-on’s settings or visiting the Website of its manufacturer. However, because cookies allow you to take advantage of some of testrigor.com’s essential features, we recommend that you leave them turned on. For instance, if you block or otherwise reject our cookies, you will not be able to use any testrigor.com services that require you to Sign in.

Does testrigor.com share the information it receives?

Information about our customers is an important part of our business, and we are not in the business of selling it to others. We share customer information only as described below and with subsidiaries testRigor Inc controls that either are subject to this Privacy Notice or follow practices at least as protective as those described in this Privacy Notice.

Third-Party Service Providers: We employ other companies and individuals to perform functions on our behalf. Examples include, sending e-mail, removing repetitive information from customer lists, analyzing data, providing marketing assistance, providing search results and links (including paid listings and links), processing credit card payments, and providing customer service. They have access to personal information needed to perform their functions, but may not use it for other purposes.

Business Transfers: As we continue to develop our business, we might sell or buy subsidiaries, or business units. In addition, we may engage in negotiations regarding mergers, financings, acquisitions or dissolutions, transactions or proceedings involving the sale, transfer, divestiture, or disclosure of all or a portion of our business or assets. In such transactions or negotiations, customer information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing Privacy Notice (unless, of course, the customer consents otherwise).

Protection of testRigor Inc and Others: We release account and other personal information when we believe release is appropriate to comply with the law; enforce or apply our Terms of Service and other agreements; or protect the rights, property, or safety of testRigor Inc, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction. Obviously, however, this does not include selling, renting, sharing, or otherwise disclosing personally identifiable information from customers for commercial purposes.

With Your Consent: Other than as set out above, you will receive notice when information about you might go to third parties, and you will have an opportunity to choose not to share the information. Disclosures Applicable Only To TestRigor’s “Free Public Plan” or Test Suites you choose to make public: Not withstanding the disclosures above, you should understand that if you sign up for our “Free Public Plan,” or on test suites you have chosen to make public all information that you provide to us in connection with that product, including information you provide to us during the sign-up process except your own password to enter testRigor, information you use or generate through your use of that product, and usernames and passwords used by you to access system under test, will be made publicly available. You should keep this fact in mind when you sign up for our “Free Public Plan” and create usernames and passwords in that environment. We may display this information on our public website, including the landing page of our website. If you have any questions regarding the use of information you provide to us in connection with our “Free Public Plan” product, please contact us as described below.

What security measures have we implemented?

We take security very seriously, that’s why we are SOC2 compliant. We maintain measures intended to protect your personal information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. For example, we use Transport Layer Security (TLS) protocol, which encrypts information you input, to protect information you submit via our Services. And we encrypt all the data at rest.

We reveal only the last four digits of your credit card numbers when confirming an order. Of course, we transmit the entire credit card number to the appropriate credit card company during order processing.

It is important for you to protect against unauthorized access to your password and to your computer. Be sure to sign off when finished using a shared computer.

Unfortunately, despite these efforts, no security measures are failsafe and we cannot guarantee the security of your personal information.

What about third-party advertisers?

testRigor does not display Third-Party advertisements on testrigor.com at this time.

What information can I access?

testrigor.com gives you access to a broad range of information about your account and your interactions with testrigor.com for the limited purpose of viewing and, in certain cases, updating that information. The list of information you can access will change as our Web site evolves.

California Shine the Light DisclosureUnder California Civil Code Sections 1798.83-1798.84, California residents can request and obtain from us once a year and free of charge a list of all third parties to which we have disclosed certain personal information covered by the law during the preceding calendar year for the third parties’ direct marketing purposes. If you are a California resident and want such a list, please contact us at sales(at)testrigor.com. If you are a California resident and would like a copy of this notice, please submit a written request to: sales(at)testrigor.com. We reserve the right to confirm your California residency before processing these requests.

What choices do I have?

As discussed above, you can always choose not to provide information, even though it might be needed to use a service or to take advantage of such testrigor.com features as Your Profile. You can add or update certain information on pages such as those referenced in the “Which Information Can I Access?” section. When you update information, we usually keep a copy of the prior version for our records.

We will keep your personal information for as long as it remains necessary for the identified purpose or as required by law, which may extend beyond the termination of our relationship with you. We may retain certain data as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally-identifiable data, account recovery, or if required by law. All personal information we retain will remain subject to the terms of this Privacy Notice. Please note that if you request that your personal information be removed from our databases, it may not be possible to completely delete all of your personal information due to technological and legal constraints.

Are children allowed to use testrigor.com?

testrigor.com does not sell products for purchase by children under the age of 13, and we do not intentionally gather personal information from visitors to our website who are under the age of 16. If you believe that we may have collected any personal information from a child under 16, please contact us.

Terms of service, notices, and revisions

If you choose to visit testrigor.com, your visit and any dispute over privacy is subject to this Notice and our Terms of Service, including limitations on damages, resolution of disputes, and application of the law of the state of California. If you have any concern about privacy at testrigor.com, please contact us with a thorough description, and we will try to resolve it. Our business changes constantly, and our Privacy Notice and the Terms of Service will change also. We may e-mail periodic reminders of our notices and conditions, unless you have instructed us not to, but you should check our Web site frequently to see recent changes. Unless stated otherwise, our current Privacy Notice applies to all information that we have about you and your account.

Examples of information collected

Information You Give Us: You provide most such information when you search, post, participate in a questionnaire, or communicate with customer service. For example, you provide information when you search for a product; place an order through testrigor.com; provide information in your Profile; communicate with us by phone, e-mail, or otherwise; complete a questionnaire; provide employer information when opening a corporate account; participate in Discussion Boards or other community features; provide and rate Answers. As a result of those actions, you might supply us with such information as your name, address, and phone numbers; credit card information. We do not store your full credit card information details. This information goes directly to our payment provider, however we do store parts of this information for your convenience.

Automatic Information: Examples of the information we collect and analyze include the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information such as browser type, version, and time zone setting, browser plug-in types and versions, operating system, and platform; purchase history, which we sometimes aggregate with similar information from other customers to create aggregate activity and usage data across our user population; the full Uniform Resource Locator (URL) clickstream to, through, and from our Web site, including date and time; cookie number; services you viewed or searched for; and the phone number you used to call us. We may also use browser data such as cookies, Flash cookies (also known as Flash Local Shared Objects), or similar data on certain parts of our Web site for fraud prevention and other purposes. During some visits we may use software tools such as JavaScript to measure and collect session information, including page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page.

Information from Other Sources: Examples of information we receive from other sources include updated address information from third parties, which we use to correct our records and communication more easily; account information, purchase or redemption information, and page-view information from some merchants with which we operate co-branded businesses or for which we provide technical, fulfillment,or other services; search results and links; and credit history information from credit bureaus, which we use to help prevent and detect fraud and to offer certain credit or financial services to some customers.

Information You Can Access: Examples of information you can access easily at testrigor.com include up-to-date information regarding recent orders; personally identifiable information (including name, e-mail, password, phone, company, industry); some payment settings; and your Profile.

Notice to California Users

Pursuant to the California Consumer Privacy Act of 2018 (“CCPA”), natural persons who are California residents have certain rights concerning their personal information held by us, as described below. This notice shall apply only to residents of California, and may be subject to change.

FOR PURPOSES OF THE CALIFORNIA CONSUMER PRIVACY ACT, WE DO NOT AND WILL NOT SELL YOUR PERSONAL INFORMATION, NOR DO WE SELL ANY PERSONAL INFORMATION OF MINORS UNDER 16 YEARS OF AGE. We also do not utilize your sensitive personal information for the purpose of inferring characteristics about you.

California Privacy Rights: To the extent provided for by law and subject to applicable exceptions, California residents have the following privacy rights in relation to the personal information we collect:

  • The right to know what personal information we have collected about you in the 12 months before your request and how we have used and disclosed that personal information;
  • The right to request deletion of your personal information;
  • The right to request correction of your personal information if the personal information we have about you is inaccurate; and
  • The right to be free from discrimination relating to the exercise of your California privacy rights as described in this section.

Opt-Out Preference Signals: Some web browsers allow consumers to automatically exercise their right to opt-out of the sale or sharing with all businesses they interact with online by initiating an opt-out preference signal. We will honor such opt-out preference signals to the extent required by law.

Verification: In order to protect your personal information from unauthorized access or deletion, we may require you to verify your login credentials or engage in other identity verification procedures before you can submit a CCPA request. If you do not have an account with us, or if we suspect fraudulent or malicious activity, we may ask you to provide additional personal information for verification. If we cannot verify your identity, we will not provide, correct or delete your personal information.

Authorized Agents: You may submit CCPA request(s) through an authorized agent. If you do so, the agent must present signed written permission to act on your behalf and you may also be required to independently verify your identity with us.

Notice to European Users

The information provided in this “Notice to European Users” section applies only to individuals in Europe.

Personal information. References to “personal information” in this Privacy Policy are equivalent to “personal data” governed by European data protection legislation.

Controller. We are the controller of your personal information covered by this Privacy Policy for the purposes of European data protection legislation, except to the extent that we process your personal information on behalf of our customer, in which case our customer is the controller of your personal information, and we are the processor.

Legal bases for processing. We use your personal information only as permitted by law. Our legal bases for processing the personal information described in this Privacy Policy are described in the table below.

Sensitive personal information. We ask that you not provide us with any sensitive personal information (e.g., information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background or trade union membership) on or through the Services, or otherwise to us.

If you provide us with any sensitive personal information when you use the Services, you must consent to our processing and use of such sensitive personal information in accordance with this Privacy Policy. If you do not consent to our processing and use of such sensitive personal information, you must not submit such sensitive personal information through the Services.

Automated Decision-Making and Profiling. We do not use automated decision-making and/or profiling in regard to your personal information in connection with the Services.

Retention. We retain personal information for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements, to establish or defend legal claims, or for fraud prevention purposes.

To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.

When we no longer require the personal information we have collected about you, we will either delete or anonymize it or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible. If we anonymize your personal information (so that it can no longer be associated with you), we may use this information indefinitely without further notice to you.

Your rights.

European data protection laws give you certain rights regarding your personal information. If you are located within the European Economic Area or Switzerland, you may ask us to take the following actions in relation to your personal information that we hold:

  • Access. Provide you with information about our processing of your personal information and give you access to your personal information.
  • Correct. Update or correct inaccuracies in your personal information.
  • Delete. Delete your personal information.
  • Transfer. Transfer a machine-readable copy of your personal information to a third party of your choice.
  • Restrict. Restrict processing of your personal information.
  • Object. Object to our reliance on our legitimate interests as a legal basis of our processing of your personal information that impacts your rights.

We may request specific information from you to help us confirm your identity and process your request. Applicable law may require or permit us to decline your request. If we decline your request, we will tell you why, subject to legal restrictions. If you would like to submit a complaint about our use of your personal information or our response to your requests regarding your personal information, you may contact us or submit a complaint to the data protection regulator in your jurisdiction. Cross-Border Data Transfer.

If we transfer your personal information out of Europe to a country not deemed by the European Commission to provide an adequate level of personal information protection, the transfer will be performed:

  • Pursuant to the recipient’s compliance with standard contractual clauses or Binding Corporate Rules;
  • Pursuant to the consent of the individual to whom the personal information pertains; or
  • As otherwise permitted by applicable European requirements.

Notice of Privacy Practices with Respect to Protected Health Information

The following notice is only provided to health care providers or those who are “covered entities” under the Health Insurance Portability and Accountability Act (“HIPAA”), to the extent that you may consider providing any individual’s protected health information (“PHI”) or personally identifiable information (“PII”) to us.

As a virtual testing platform, we require that you (1) mask, aggregate, or anonymize any sensitive information you would provide us with the purpose of running test cases, or (2) only use fictitious data in our test cases, and (3) do not upload or utilize any real individual’s PII or PHI on testRigor’s platform, systems, or services, via any browser, API, or any other means. However, we may permit you to utilize real PHI or PII in test cases for special consideration. If so permitted by us, we will protect the privacy and/or security of any real PHI as required under the HIPAA and, if applicable, in the ways as required under the Business Associate Agreement entered into between us.
